These terms are designed for the current BlinqCar workflow. They must be approved by India-qualified counsel before paid public launch.
BlinqCar Mobility Technologies Pvt. Ltd.
Grievance Officer: To be appointed · info@blinqcar.com
Launch configuration still required: registered address, Grievance Officer name, grievance phone.1. Agreement and scope
These Marketplace Terms apply when you access blinqcar.com, create an account, browse, save, list, enquire, purchase a package, request a rental or use another BlinqCar service that links to them. Role-specific policies and the Privacy Notice form part of the agreement.
If a confirmed order displays service-specific terms, those terms apply to that order. Mandatory rights under applicable law are not excluded. Do not transact if you do not agree.
2. BlinqCar’s role
BlinqCar provides technology, moderation, account, communication and operational workflows for a multi-sided vehicle marketplace. Unless a confirmation expressly identifies BlinqCar as seller, lessor, repairer, insurer, lender or payment provider, the relevant third party remains responsible for that regulated or vehicle-specific service.
Publication, account verification or an inspection label does not by itself guarantee title, condition, roadworthiness, price, finance, insurance, legality, availability or conduct.
3. Eligibility, accounts and OTP security
You must be at least 18 years old and legally capable of entering the relevant transaction. Provide accurate information and use an email account you control. One-time codes are confidential and must never be shared with another person, including someone claiming to represent BlinqCar.
You are responsible for activity through your session unless you promptly report unauthorised access. BlinqCar may require re-verification, revoke sessions, restrict features or suspend an account where security, fraud or legal risk reasonably requires it.
4. Listings, moderation and inventory
Sellers and hosts are responsible for their claims, authority, price, availability, vehicle condition, documents and original media. Public inventory appears only after the listing reaches the required moderation state.
BlinqCar may request corrections, reject prohibited content, pause stale inventory and preserve moderation records. Approval means only that the checks then applied were completed; it is not a warranty or a promise that a transaction will occur.
5. Discovery, DriveSense and user judgment
Search, filtering and DriveSense help organise approved listing information. Explanations are based on disclosed user inputs and available fields, can be incomplete, and must not replace inspection, test drive, document verification or independent professional advice.
BlinqCar does not make an automated credit, insurance, legal-eligibility or safety decision through DriveSense. Pricing or potential value information is indicative unless a separate binding offer states otherwise.
6. Enquiries, offers and communications
Listing-linked messages help connect verified accounts and preserve transaction context. A message, offer or counteroffer is not a completed contract until the parties satisfy the written confirmation, payment, document, handover and authority requirements for that transaction.
Do not request or disclose an OTP, password, full card number or unnecessary identity data. BlinqCar may review reported or lawfully required records for moderation, safety, dispute handling and fraud prevention.
7. Publishing packages and paid services
Publishing a sale or rental listing may require an active package. Checkout identifies price, taxes, validity, capacity and applicable conditions. A package grants limited access to the described workflow; it does not guarantee approval, ranking, enquiries, sale, rental, valuation or income.
No automatic renewal applies unless checkout clearly states it and obtains any required authorisation. Payments activate only after server-side verification. Separate Payments & Refunds terms explain cancellation and processing.
8. Vehicle sale, rental and transfer
For a sale, the parties must verify identity, title, finance, original records, written terms, cleared payment, possession and ownership-transfer requirements. Follow the relevant registering authority; delivery alone is not legal transfer.
For a rental, the parties must confirm driver eligibility, dates, price, deposit, permitted use, insurance, limits, condition, return, fines, tolls and incident handling. Never assume a private vehicle may lawfully be rented merely because a listing exists.
9. Inspection and restoration
An inspection reports the observed scope and condition at a particular time. It cannot reveal every hidden, future or intermittent issue and is not a manufacturer warranty or roadworthiness certificate.
Restore by Blinq starts only after scope, price and authorisation are documented. Any estimated improvement in selling value is not guaranteed. The service terms control workmanship, delivery, exclusions and remedies.
10. Acceptable use and content licence
Do not use BlinqCar for fraud, impersonation, harassment, stolen vehicles, unlawful rentals, unsafe payments, access-control bypass, harmful automation or misleading content. The Acceptable Use Policy provides additional detail.
You retain ownership of content you lawfully upload and grant BlinqCar a non-exclusive, worldwide, royalty-free licence to host, reproduce, resize and display it only as reasonably needed to operate, secure and promote the listing and service. The licence ends when no longer operationally or legally required.
11. BlinqCar intellectual property
BlinqCar names, interface, code, artwork and original content are protected by applicable rights. These Terms grant a limited, revocable, non-transferable right to use the service for its intended marketplace purpose, not to copy, resell, scrape or reverse engineer protected parts.
12. Disclaimers and allocation of risk
The service is provided on an “as available” basis to the extent permitted by law. BlinqCar does not promise uninterrupted access, a particular inventory level, transaction outcome, third-party conduct or that every user claim is true.
Nothing excludes liability or a remedy that cannot lawfully be excluded, including mandatory consumer protections. Each party remains responsible for fraud, wilful misconduct, unlawful content and its own transaction obligations. Final limitation and indemnity wording must be approved by counsel for the exact operating model before paid launch.
13. Suspension, removal and termination
BlinqCar may restrict content, listings, payments or accounts where reasonably necessary to protect users, investigate risk, comply with law, prevent misuse or enforce these terms. Where practical and lawful, we will explain the action and available review channel.
You may stop using the service and request account closure, subject to records that must be retained for active transactions, fraud prevention, security, tax, legal claims or other lawful obligations.
14. Complaints, governing law and changes
These Terms are governed by Indian law. The final registered-office jurisdiction and any dispute-resolution clause must be inserted only after counsel confirms the contracting entity and operating states; this draft intentionally does not invent them.
Material changes will be posted with an updated date and, where required, presented for notice or consent. Send a formal grievance to info@blinqcar.com with the relevant record reference.
Keep the record attached.
Email info@blinqcar.com from your account address and include the relevant listing, conversation, payment or rental reference.
